V916.04 Building Access
A. Purpose Controlling access to buildings and rooms is a vital element in maintaining VCSU campus security. This policy provides guidelines for the control and issuance of access devices. B. Definition All mention of the term "access device" within this policy will refer to the University's keys, computerized access cards, and any future access devices used on any approved access system at Valley City State University. C. General Provisions 1. The Facilities Services department is charged with the responsibility to coordinate access control and building security policies Each department/unit is responsible for ensuring that proper building security practices are maintained by each respective department. Each department/unit is responsible for ensuring the return of key(s) and requesting removal of access of a department member or student who no longer needs access to an area. Institutional Security System enhancements: An electronic network has been established to provide access control and monitor various activities on campus, involving access control devices, intrusion devices, and video cameras, where applicable. The access control devices are installed at select interior and exterior doors and spaces. 2. Procedure for issuance of access devices to employees Supervisors request specific access devices for employees by completing and signing the key request form or the card access request form. Facilities staff determines if the request is appropriate and is within the interest of campus safety and security and have issuance authority. Formal written appeals related to Facilities staff determination may be made to the Vice President for Business Affairs and President. Facilities maintains a database of access devices issued and returned Employees present a valid VCSU ID at time of issuance of approved access device(s). 3. Procedure for issuance of access devices to students Residence hall access devices are issued to students by the Housing staff Facilities Services issues access devices to student workers only under special circumstances. For student positions defined by, or matching, the positions in V602.3.1 VCSU Criminal Records Check Policy, access devices will not be issued until results of a background records check are reviewed and approved. Access devices may be provided to students for entry to buildings or specific rooms after hours for instructional use. Facilities Services will determine the specific buildings to which access will be permitted. It is the responsibility of the course instructor to inform the Facilities Services staff of the times designated areas should be available to students and the names of the students who have been granted permission to access these areas after hours. After approval, students sign for the access device from a Facilities Services professional at time of issuance. 4. Duplication of university access devices is not permitted 5. Lending of access devices to others is not permitted 6. Access device exchange Swapping access devices between individuals is prohibited. Individuals will contact the Facilities Services office to assist in transference of access devices. 7. Inventory Audit The Facilities Services department will perform an annual audit of all issued access devices. The Facilities department reserves the right to perform an access device audit at any time. As a result of the annual audit, the Facilities Services department will determine if the current level of access is appropriate for the job position. The Facilities department reserves the right to recover from employees any access devices that grant the employees access other than what is required for their position. Individuals and the department have the right to appeal decisions made by the Facilities Services department by contacting the Vice President for Business Affairs. 8. Vendors and Contractors Vendors and Contractors will be required to check out access devices from the Facilities office. A temporary access device contract will be completed and signed by the individual requesting the access device at the time of issue and will be dated and initialed by a Facilities staff member upon return of the device. 9. Return of access devices All employees who leave employment with VCSU must complete the campus check-out procedure, which includes turning in all access devices to Facilities Services. Returned devices will be matched against the access record for the employee to ensure all devices are returned. Employees will return access devices or notify the Facilities Services office when specific access is no longer needed to perform the employee's assigned responsibilities. 10. Loss or failure to return access devices If an employee or student fails to return an issued access device, facilities services will contact the employee or student to secure return of the devices. Employees and students may be personally charged for the cost of re-keying offices or buildings if physical keys are lost or not returned as required. If an access device is lost or stolen, it is the responsibility of the individual assigned the device to notify the Facilities department immediately. It is a security breach when a lost, stolen, or non-returned key is either an outside door key or a building master key. It is mandatory that the affected doors be re-keyed. V916.05 Viking ID Terms and Conditions
A. Definitions Viking ID: This is the official form of identification at Valley City State University, as well as a declining balance debit account. There are two forms of Viking ID: 1) Viking ID Card and 2) Viking Mobile ID. Viking Mobile ID: an app associated with a mobile device. Viking ID Card: a physical, plastic card. ID owner: The individual associated with and responsible for the Viking ID. B. VIKING ID All on-campus faculty, staff and students are required to have a Viking ID for identification, security, and access to University buildings and services. The Viking ID should be carried at all times while on the VCSU campus. The Viking ID is valuable and should be treated like cash, a credit card or a key. Valley City State University issues a Viking ID subject to the following terms and conditions: An ID owner must present the Viking ID for identification if requested by a University official. The Viking ID must be presented upon any request for campus services. ID owners with primary role of Student must choose either the Viking ID Card, or the Viking Mobile ID. A Student ID owner cannot have both forms of Viking ID. ID owners with primary role of Faculty or Staff may have both forms of Viking ID, even if they have a secondary role of Student. An ID owner may only possess one valid Viking ID Card. Any ID card that has been replaced after it was lost or stolen is no longer valid. ID cards cannot be reactivated. If an ID owner with primary role of Student already has a Viking ID Card, it will stop working within a few days after activating the Viking Mobile ID. To obtain a Viking ID, an individual must first be assigned a university generated identification number and be an active VCSU user. The ID owner must be validated through an online submission process for the Viking Mobile ID, or be present on campus to receive the Viking ID Card. If off campus, another employee acting on behalf of VCSU may personally validate the information and photo of the Viking ID Card to the ID owner; mailing is not permitted. The Viking ID is intended for campus use only and must be returned upon request. The Viking ID is non-transferable and will be confiscated and returned to the Student Center Information Desk if found in the possession of another person. Sharing the Viking ID with another person is strictly prohibited. The ID owner will not damage or alter the Viking ID Card in any manner. This includes, but is not limited to, punching holes in or affixing unapproved stickers to the Viking ID Card or electronically altering or copying the Viking Mobile ID. The Viking ID, transactions and activities related to the use of the Viking ID, and any account balances are the sole responsibility of the individual ID owner. IMMEDIATELY report lost, found, or stolen Viking ID Cards or mobile devices with the Viking Mobile ID to the VCSU Student Center Information Desk (701-845-7990). An ID owner may also deactivate a lost or stolen Viking ID Card or Viking Mobile ID in eAccounts. A new or replacement Viking ID Card can be obtained at the Student Center Information Desk for a $25 fee. Viking ID Cards for all faculty and staff may be charged to his/her department. Billing information is required at the time of the card production. There is no fee for the Viking Mobile ID. The Viking ID is valid for as long as the person retains their student, faculty or staff status at VCSU. Associate Status for any individual/group must have prior approval by the VCSU President or Vice President for Student Affairs. Associate Status is granted to groups or individuals who may work on or visit the campus, but are not students or employees of the University. Associate Status does not guarantee access to all VCSU activities, events, and facilities. A Viking ID may be revoked or deactivated if it is determined that abuse of the privileges associated with the Viking ID has occurred. Students who misuse their Viking IDs may also be referred to the Vice President for Student Affairs for possible disciplinary actions. Faculty or staff misuse will be reported to the faculty or staff member's supervisor. C. VIKING DOLLARS ACCOUNT Viking Dollars is a debit account service that is linked to the Viking ID. This benefit is free to ALL students, faculty and staff. There are NO hidden charges, expenses or interest for using Viking Dollars. A $5 minimum is required for opening a Viking Dollars account and for additional deposits. No minimum balance must be maintained. Cash refunds are not given for any Viking ID purchases at any participating merchants. Credit is returned to the Viking ID account. Viking Dollars balances carry over from semester to semester. Refunds on any balance above $20 at the end of the academic year are available by submitting a Refund Form. For balances below $20, the ID owner is required to spend out this amount. For those students who are graduating, withdrawing, or cancelling enrollment from the University, and who also have a balance of $20 or more on their Viking Dollars accounts, the University will first apply the balance to the student's university account. If there is no money owed to the student's VCSU account, a refund will be generated. Balances under $20 must be spent out within a year of the last transaction (see item 6 below). Account balances under $20 will be cleared for accounts that are inactive for more than one year from the date of the last transaction. ID owners with checks returned for insufficient funds will have accounts frozen until payment is received. Funds are non-transferable. IMMEDIATELY report a lost or stolen Viking ID to the VCSU Student Center Information Desk (701-845-7990). An ID owner may also deactivate a lost or stolen Viking ID in eAccounts. Once the Viking ID has been reported lost, the ID owner is not responsible for any additional purchases. Per federal regulations, the ID owner is responsible for up to $50 if the lost or stolen Viking ID is reported within two business days. If the lost or stolen Viking ID is not reported within two business days, the ID owner can be liable up to $500 or the total account balance, whichever is lower. Privacy Statement: Through the Family Educational Rights and Privacy Act, also known as FERPA or the Buckley Amendment, data collected on the use of University facilities and services by an individual ID owner will only be used for University purposes within FERPA guidelines. Information regarding a ID owner’s account will not be provided to third parties unless by applicable laws or within written permission of the ID owner. V917 Cannabis, Nicotine, and Tobacco Free Campus
Rationale for Prohibiting Smoking, Cannabis, Nicotine, and Tobacco Products Use Valley City State University is committed to a healthy and safe environment for students, employees, and visitors. Use of cannabis, nicotine, and tobacco products including but not limited to, e-cigarettes and vaping products is prohibited on all campus property. Campus property includes all property, both indoor and outdoor, that is owned, operated, leased, occupied, or controlled by Valley City State University, all buildings, green spaces, athletic fields, parking lots, sidewalks, walkways, and state vehicles. This policy applies to all employees, students, visitors, and contractors. The purpose of this policy is to protect the public health and welfare by prohibiting smoking and the use of cannabis, nicotine, and tobacco products, including Electronic Smoking Device (ESDs); to guarantee the right of nonsmokers to breathe smoke free air, while recognizing that the need to breathe smoke free air shall have priority over the desire to smoke; and to encourage a healthier, more productive living/learning environment for all members of our campus community. The smoking of tobacco, hookahs, nicotine. or cannabis products and the use of ESDs are forms of air pollution and constitute both a danger to health and a material public nuisance. Prohibition of Cannabis, Nicotine, and Tobacco Products Use and Advertising Valley City State University prohibits the use of all forms of cannabis, nicotine, and tobacco products on campus property and at all off-campus, school-sponsored events at all times. This cannabis, nicotine, and tobacco-free policy includes all events held on campus property, whether or not such events are sponsored by, or associated with, Valley City State University. This does not include any products approved by the United States Food and Drug Administration for legal sale as a tobacco cessation product and is being marketed and sold solely for the approved purpose. No cannabis, nicotine, and tobacco related advertising or sponsorship shall be permitted on campus property or in campus publications. “cannabis, nicotine, and tobacco related” refers to the use of a cannabis, nicotine, and tobacco brand, corporate name trademark, logo, or any other product identifiable with any brand of cannabis, nicotine, or tobacco or Tobacco Company. Valley City State University prohibits the sale or free sampling of cannabis, nicotine, and tobacco products on campus property and at off-campus, school-sponsored events. Definitions Electronic smoking devices include any product containing or delivering nicotine, CBD, THC, or any other substance intended for human consumption that can be used by a person in any manner for the purpose of inhaling vapor or aerosol from the product. The term includes any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, e-hookah, or vape pen, or under any other product name or descriptor, but does not include medically prescribed inhalers. Hookah is defined as a water pipe and any associated products and devices which are used to produce fumes, smoke, and/or vapor from the burning of material including, but not limited to, tobacco, shisha, or other plant matter. Smoking is defined as inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe, hookah, or any other lighted or heated tobacco, nicotine, or plant product intended for inhalation, including cannabis products, whether natural or synthetic, in any manner or in any form. Smoking also includes the use of an electronic smoking device which creates an aerosol or vapor, in any manner or in any form, or the use of any oral smoking device for the purpose of circumventing the prohibition of smoking in this policy. Tobacco products: include but are not limited to, tobacco leaf, cigarettes, cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping tobacco, bidis, blunts, clove cigarettes, any other preparation of tobacco, or any product or formulation of matter containing biologically active amounts of nicotine that is manufactured, sold, offered for sale, or otherwise distributed with the expectation that the product or matter will be introduced into the human body by inhalation, ingestion, or absorption. Nicotine products: include but are not limited to, nicotine pouches, nicotine toothpicks, or any product or formulation of matter containing biologically active amounts of nicotine that is manufactured, sold, offered for sale, or otherwise distributed with the expectation that the product will be introduced into the human body by inhalation, ingestion, or absorption. Cannabis product includes any substance containing THC and/or any psychoactive substances derived from the hemp and cannabis plants such as Delta products. This includes but is not limited to flowers, concentrates, edibles, topicals, oral products, vape products, and transdermal products. Assistance for tobacco cessation is available through Student Health Services. Individuals requesting assistance with tobacco cessation services will be referred to NDQuits, the North Dakota Department of Health multi-media tobacco cessation program. This is a free cessation service provided to anyone currently residing in North Dakota. Exemptions It is not a violation of this policy for an adult Native American to use tobacco as part of a traditional Native American spiritual or cultural ceremony according to SBHE 917 Smoke-Free Facilities. Contact the Vice President for Student Affairs to obtain approval for an on-campus ceremony. All parties impacted by the ceremony will be informed and an agreement will be reached regarding the date and time for the ceremony. Communication of Cannabis, Nicotine, and Tobacco-free policy This policy will be printed in the employee and the student handbooks. Valley City State University shall post signs indicating that the campus property is tobacco-free in all locations and in the manner identified in NDCC 23-12-10.4.1(a) and (b). In addition, notices should be posted in other highly visible places on campus property including, but not limited to, walkways, athletic fields, parking lots and at all off-campus, school-sponsored events. In accordance with Valley City State University’s plan for communicating this policy, the Vice President for Student Affairs will communicate the importance of the tobacco-free campus policy at least once per semester via campus-wide emailing to all students and employees. Responsibility/Enforcement Enforcement of this policy will depend upon the cooperation of all faculty, staff and students to not only comply with the policy, but also to encourage others to comply in order to promote a healthy environment in which to work, study and live. Violations of this policy should be referred to the appropriate administrative office for review and appropriate action: for faculty, the Office of the Vice President for Academic Affairs; for staff, the Office of the Vice President for Business Affairs; for students, the Office of the Vice President for Student Affairs. V918 Alcoholic Beverages
1. Definition: "Alcoholic beverages" means any liquid suitable for drinking by human beings, except prescription drugs or over-the-counter medications, which contains one-half of one percent or more of alcohol by volume. 2. The possession, sale, service, use, or consumption of alcoholic beverages upon land or in buildings at institutions under control of the Board is prohibited, except as authorized by the institution's president. 3. Alcoholic beverages may not be purchased with public funds unless the alcoholic beverages will be used for authorized training or educational purposes. V918.01 VCSU Football Tailgating with Alcohol Policy
The following policy has been developed for Football Tailgating with Alcohol (TWA) at Valley City State University. We appreciate your cooperation in observing each of these points which are provided in the best interest of health and safety of all. Tailgating area VCSU will designate a tailgating lot. Tailgating with alcohol will be allowed only within its perimeter. A limited number of parking spaces will be made available and issued on a first come, first served basis. Some spots may be made available to reserve through the Athletic Department. Costs associated with reserved tailgating will be established by VCSU and VCSU Century Club and published annually. Rules and regulations will be established to maintain a safe, healthy, and family friendly environment. Tailgaters are reminded to follow all university, local, state, and federal laws/policies. Tailgating hours Lot is open 3 hours before kickoff (example: Game time 1:00 TWA area open at 10:00) Tailgating with alcohol will end at the start of the game and be allowed at halftime. No tailgating with alcohol is allowed during the game. The tailgating area will be cleared out of people before kickoff of each half. The tailgating area will be monitored by VCSU personnel or appointee. Rules and Regulations The University reserves the right to restrict any vehicle or person for any reason. Beer kegs are prohibited. Drinking games are prohibited and the use of devices intended to accelerate the consumption of alcohol are prohibited. Under no circumstances shall persons under 21 years of age have possession of or consume alcohol. No alcoholic beverages allowed outside the tailgating area. Individuals who interfere with the rights of other people by use of loud and/or abusive language and behavior will be asked to leave the event. Individuals may be subject to legal penalties. Tailgating individuals will be responsible for keeping the area clean. Trash cans will be available. No open flame fires, fireworks or fire pits. Propane and charcoal grills are permitted. Restrooms will be available. No retail sales allowed. Rules and regulations will be enforced.
