Higher Education Opportunity Act
VCSU - HEOA Annual Disclosure History The Higher Education Opportunity Act (HEOA) was signed into law on August 14, 2008. Proposed regulations for implementing the Act were issued by the United States Department of Education on August 21, 2009, and final regulations were issued on October 29, 2009. Valley City State University is providing you this notice in compliance with that legislation and the Department of Education's regulations in 34 C.F.R. Part 668 (Subpart D). When signing the University Student Computing Resources Contract and/or registering your network addressable device for use on VCSU's network, you agree to abide by the North Dakota University System procedure 1201.2 Acceptable use Policy and VCSU's addendum to that policy. Specifically with regards to copyright law, you agreed not to use University resources for unauthorized duplication, use, or distribution of copyrighted materials. The University considers peer-to-peer file sharing of copyrighted materials to be an inappropriate use of its network resources. Furthermore, such activity is illegal under the Digital Millennium Copyright Act (DMCA) and may subject you to civil and criminal penalties. Summary of Civil and Criminal Penalties for Violation of Federal Copyright Laws Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-sharing context, downloading or uploading substantial parts of a copyrighted work without authority constitutes an infringement. Penalties for copyright infringement include civil and criminal penalties. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or "statutory" damages affixed at not less than $750 and not more than $30,000 per work infringed. For "willful" infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorneys' fees. For details, see Title 17, United States Code, Sections 504, 505. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. For more information, please see the Web site of the U.S. Copyright Office at www.copyright.gov, especially their FAQ's at www.copyright.gov/help/faq. Copyright Infringement Notifications Copyright holders and organizations that represent copyright holders, such as the Recording Industry Association of America (RIAA) and Motion Picture Association of America (MPAA), typically send out three different types of communications related to copyright infringement: Cease and desist, or copyright infringement notices (Take Down notices) - The purpose of these notices is to stop the illegal possession and distribution of copyrighted material. Pre-litigation notices - These letters are used by copyright holders and their representatives prior to filing a lawsuit to recover, by way of a settlement, financial damages caused by the illegal distribution of copyrighted material. If a network account holder has been identified as participating in the illegal downloading or uploading of copyrighted materials, that individual may receive one of these notices, even if they have already destroyed their copy (or copies) of the material in question. Subpeonas - These notices indicate the copyright holder has filed a lawsuit to recover damages for the illegal distribution of copyrighted material Those found liable will be subject to fines and penalties. VCSU Procedures and Policy When the VCSU IT Security Officer (ITSO) receives a notice from the ND University System Digital Millenium Copyright Act (DMCA) agent claiming an alleged copyright violation has occurred and identifying a particular IP address, network activity records are reviewed to independently validate the legitimacy of the complaint. If the complaint appears valid, the user whose IP address has been identified in the notice is notified. The user is given information on what steps must be taken to achieve compliance with VCSU and NDUS policy and a copy of the incident is placed in the student's personal conduct file. Upon completion, the ND University System Digital Millenium Copyright Act (DMCA) agent is notified. Repeat offenders are subject to broader sanctions as imposed by the Vice President for Student Affairs ranging from network access suspension to expulsion from the University. Compliance Plan Education Several methods have been developed to help educate the campus community including faculty, staff and students regarding copyright infringement. Email is sent and web sites post information regarding peer-to-peer (P2P) use and copyright infringement. During annual orientation sessions, videos and powerpoints are shown that discuss copyright infringement, the DMCA and the responsible use of P2P software. Technology-based deterrents used by VCSU VCSU follows a vigorous formal, documented, and established procedure of accepting and responding to DMCA notices. All network addressable devices must be registered with VCSU's Network Services Department before the device is allowed access the the network. The registration process occurs prior to the beginning of each semester and captures the username and MAC address of the device for identification purposes. Annual Review The VCSU Information Technology Security Officer and Chief Information Officer will review the effectiveness of the ongoing effort to promote legal use of copyrighted materials on a yearly basis and consider improvements. The volume of DMCA notices received and other relevant data collected by Technology Services staff will be used to determine whether the University remains in compliance or if changes are needed. Any changes to the policy and/or procedures as a result of the review will take effect prior to the following academic year. Requesting a Live Streaming Event
VCSU Technology Services now offers video recording and streaming of live events. We can live stream your campus event using 2 HD cameras, tie into your soundboard, and also use our mics to capture high-quality sound. We can push your stream to the VCSU YouTube channel or use your preferred social media streaming site. If you have an event you'd like live streamed or recorded, please fill out this One Stop form at least two weeks in advance of your event. We promise to make our best effort to cover your event, and the earlier you request it, the better chance we will have the date open. One thing to consider is your event location. To stream it live, we need a wired ethernet connection to the internet, so not all sites work. We can still record and post to YouTube later if no internet connection is available. Laptop FAQ
Q: How will a laptop computer contribute to my education at VCSU? A: You can use it for word processing, communicating with faculty and other students, finding information from libraries and other sources throughout the world, developing class presentations, generating spreadsheets and databases, electronic storage of your best work in college to show when seeking employment, and many disciplines have specific applications. With this experience, you will be better prepared for any career where computers are used. Q: How will I use my laptop computer for class assignments? A: You can use it to post messages to your professors, receive updates or assistance from professors, receive lecture notes or assignments, take notes in class, send questions or comments to professor or other class members, use the Internet for research, and turn in completed assignments. Some classes also use instructional software to accompany textbooks and some professors have replaced textbooks with Internet resources. Q: What advantages do laptop computers have over conventional computer laboratories? A: No matter where you are, you have 24-hour access to libraries, databases, communication systems, job announcements, and organizations. You will be using the latest in computer hardware, software, online information and communication systems. Because laptop computers can be applied to all disciplines, faculty and students will no longer be restrained by the availability of laboratories. You will become more proficient with computer technology as you use and customize it to meet your individual needs. Q: Will there be computer training for new students? A: There will be a short care-and-use orientation before the computer is issued to you. The Introduction to Computer Information Systems course is customized for laptop computers and network services available. Incoming freshmen are encouraged to take this course. Special short courses and workshops will also be offered. Q: What if I have problems or questions about the laptop computer? A: A Technology Service Desk staffed by resource personnel will assist you. The Technology Service Desk will provide assistance with minor repairs and service, exchange computers in need of long-term repair, and issue computers to part-time students. Q: Will financial aid be available to help pay the student technology fee? A: Since the fee is paid by all students and the laptop computer is essential to the educational process, the fee is included in the student's financial aid analysis. This results in an increase in eligibility for grants, scholarships or loans. Early application is critical to receiving maximum benefits. Q: Will the laptop computers be insured for accidental damage and /or loss? A: The institution maintains insurance, but students are responsible for a $50 or higher deductible per incident in the event of damage or $500 in the event of loss if a police report is filed, otherwise a replacement cost is charged. Students can purchase their own insurance to cover the deductible. One method of obtaining this insurance is to include a rider on a homeowners or renters insurance policy with typical costs of $20/year with a deductible. Another option is to establish a separate "personal property protection" policy just for the computer. This typically costs $30/year with no deductible. Q: What if I am a part-time student and would like to have a laptop computer issued to me for the entire semester? A: Part-time students will be required to pay a portion of the fee and will be able to check out a computer from the Technology Service Desk for use in their classes. Two or three part-time students can share a computer full time by completing a "Joint Users Contract" available at the Technology Service Desk. Part-time students may choose to pay the full fee and be issued a laptop computer for the entire semester. This option is contingent on availability. Students interested in this option should notify the Technology Service Desk as soon as possible. Q: How will the laptop computer checkout for part-time students work? A: Checkout will be for class-time use (10 minutes before class and 15 minutes after class) and other times as available each semester. Open checkout times will be determined and announced at the Technology Service Desk after the last day to add a class. All part-time students must present a student identification card (ID) each time they checkout a laptop computer. This policy does not apply to students enrolled in the VCSU elementary education program at NDSU. Q: What do I do if my laptop computer is stolen? A: Report this to the Technology Service Desk immediately! The Technology Service Desk will provide a serial number. You will be required to fill out a Stolen Property Report with the nearest police department in area of theft. You must pay the $500 deductible. Q: Can I purchase my laptop computer? A: Alumni that graduate during a particular lease cycle will have the first option to purchase the laptop computers at the end of the lease. VCSU Foundation Office records will be used to contact alumni. Please ensure your contact information is current. Q: Do I have to pay the technology fee? A: All students enrolled at VCSU must pay the Technology Fee. This includes students taking classes at off-campus locations. Few, if any, fee waivers will be granted. Fee waivers must be approved by the Vice President for Academic Affairs. Q: Will NDSU students taking classes from VCSU Education faculty be required to pay the technology fee? A: Yes. NDSU students registered for one or more elementary education courses are required to pay a technology fee each semester. In return, these students are issued an iPad for use till senior year. Q: Will distance education students be required to pay the technology fee and if so, what will the collected fee provide? A: Distance education students are required to pay the technology fee. The technology fee collected from distance learners will be used to offset various added costs of instructional delivery, such as Internet services, learning management systems, and creation of electronic course materials. Q: Can a distance learner rent a VCSU laptop computer? A: Most distance learners are eligible to rent a VCSU laptop computer and some may be eligible to receive one for the cost of shipping. Signing a Computing Contract
Description: All VCSU students who check out a VCSU owned laptop, mac or pc, and/or VCSU iPad must sign a semesterly computing contract at beginning of semester. Computing contracts end the last day of that semester's finals. 1. Log in to the My VCSU Portal at https://my.vcsu.edu or download the "MyVCSU" app on your personal phone or tablet. 2. After logging in, under Tech Support section, look for a green "Computing Contract" icon as shown below. Click that icon. 3. Verify signing correct computing contract depending on semester. The title should be at top, otherwise scroll down to find another provided. Read through the Terms and Conditions. Remember, this is a legal binding document. 4. When you agree to the Terms and Conditions, click the check box and provide a valid current phone number at the bottom and submit. You can checkout a VCSU assigned laptop with valid registration and signed computing contract. Warning!: If you are using a public computer to sign the contract, do not forget to log out.
